Official Rules

NO PURCHASE NECESSARY. NO PURCHASE, PAYMENT OR OTHER CONSIDERATION IS NECESSARY TO ENTER OR WIN A PRIZE IN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT DOES NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. PARTICIPATION CONSTITUTES YOUR FULL AND UNCONDITIONAL AGREEMENT TO BE BOUND BY THESE OFFICIAL RULES. WINNING A PRIZE IS CONTINGENT ON BEING RANDOMLY CHOSEN AND FULFILLING ALL REQUIREMENTS SET FORTH IN THESE OFFICIAL RULES. ANY VIOLATION OF THESE RULES MAY RESULT IN DISQUALIFICATION, WITHOUT NOTICE OR OTHER OBLIGATION TO THE VIOLATOR. ALL DECISIONS OF SPONSOR ARE FINAL AND BINDING IN ALL RESPECTS.

 

Description of Sweepstakes Prizes. In the Sweepstakes, AOB Products Company (“Sponsor”) will award a prize awarded to the winning contestant.

 

Sweepstakes Term. The Sweepstakes begins and ends at 12:00 a.m. (EST) on the dates outlined on the Sweepstakes information (the “Sweepstakes Term”). All entries must be submitted via the instructions provided on the applicable sweepstakes information or via email during the Sweepstakes Term in accordance with these Official Rules to be eligible to win. Entries that do not comply with these Official Rules will not be eligible and will not be accepted.

Via Email: To enter the Sweepstakes via email, send an email to harvester@aob.com with the name of the Sweepstakes or reference to the posting in the subject line. An email entry must include entrant’s first and last name and email address. An email entry will earn you the maximum number of entries allowable into the Sweepstakes.

 

Entries cannot be returned or withdrawn.

 

Odds of Winning. Odds of winning a prize depend on the number of valid entries received. Many will enter, one will win. Only one (1) prize will be awarded to one (1) winner.

 

Eligibility. Sweepstakes contestants must be legal residents of the forty-eight (48) contiguous United States and the District of Columbia, who are eighteen (18) years old or older at the time of entry and who can provide proof of U.S. residency and, as required by applicable state law, a valid license to operate or use the prize being awarded. Residents of U.S. territories and possessions, U.S. military installations and diplomatic stations in foreign countries, and all other locations not physically located within the 48 contiguous United States (such as Alaska and Hawaii) are excluded from this Sweepstakes. Employees of Sponsor and its agents, affiliates, and subsidiaries and members of their families and immediate households, as well as any persons who were awarded a prize or received any promotional consideration from the Sponsor within six (6) months prior to the beginning of the Sweepstakes Term, are not eligible to participate in this Sweepstakes. Additional eligibility requirements are set forth in these Official Rules and must be met. All eligible remaining entries will be included in a random drawing for the applicable prizes that have not yet been awarded. All federal, state and local laws and regulations apply. The Sponsor's determination of eligibility, in its sole discretion, shall be final.

 

Winner. The prize winner will be selected by random drawing once immediately following the close of the Sweepstakes Term. The prize winner will be notified by method of entry (e.g., Facebook message, Instagram message, email, etc. (depending on method of entry)). The prize winner must respond to Sponsor to the notification from Sponsor, with the prize winner’s name, address, phone number, and email address within two (2) days of the notification or email from Sponsor to claim the prize. To be eligible to claim and receive the prize package, the prize winner must follow the instructions contained in his or her notification and will be required to demonstrate eligibility in accordance with these Official Rules. The potential winner shall be required to complete, sign and return within ten (10) days following such notification (or an attempted notification), an Affidavit of Eligibility, a Publicity Agreement and Release, and other necessary documentation as may be required in these Official Rules or under applicable laws. Prize winner shall not, in the opinion of Sponsor, as determined by Sponsor in its sole discretion, have engaged in conduct or speech that would tend to shock, insult, or offend the community or that would tend to diminish the reputation of Sponsor’s brands, bring Sponsor into public disrepute, contempt, scandal or ridicule, or reflect unfavorable on Sponsor or the Sweepstakes. If for any reason Sponsor is unable to contact the prize winner, or the prize winner fails to timely respond or is ineligible, the winner’s prize will be awarded in a random drawing to another eligible entrant. Sponsor, and its agents, affiliates, and subsidiaries, may use the prize winner’s name, likeness and any other information or content without compensation in advertising or otherwise.

 

Prizes; Restrictions. The prizes consist of the items specifically listed in the Sweepstakes information. The prizes are subject to availability and may be subject to additional federal, state or local restrictions. No substitution, cash equivalent or transfer of the prize (or portion of any prize) will be granted except at Sponsor’s sole discretion due to unavailability of a prize (or portion of a prize) for any reason. Any substitution by Sponsor of the prize or portion of the prize shall be made with an item of comparable or greater value. Sponsor will arrange for delivery to the residence of the Prize Winner of each Sweepstakes Prize, except that, at the sole discretion of the Sponsor, Sponsor is not responsible for prize utility, quality or other attributes. There are no warranties or guarantees of any type offered in connection with any of the prizes, except any manufactures’ warranties that may apply to a prize. Prizes may be used for advertising by Sponsor prior to being awarded to prize winner and therefore, may not be in a brand-new condition. Prize winner must meet the participation and eligibility requirements of the Sweepstakes and any other requirements set forth in these Official Rules, including providing and executing all documents and releases necessary for award of the prize. Until such requirements are timely met, you are not a prize winner, but only a potential prize winner. The prize (or any portion of the prize) is not transferable or assignable to any other party. By entering this Sweepstakes, you further acknowledge that you are not legally prohibited from owning or taking possession of the prize that you may be awarded.

 

Sweepstakes Materials. By entering into this Sweepstakes, you grant to Sponsor an irrevocable, perpetual, worldwide, non-exclusive, royalty-free, sub-licensable right and license to distribute, reproduce, modify, perform and display and otherwise use any and all content, information, posting, communication, message or other materials (including your name, image or likeness) provided by you (“Sweepstakes Materials”) for Sponsor’s and its affiliates’ use in the normal conduct of business, including marketing, promotional and sales activities. Subject to these Official Rules, you understand that Sweepstakes Materials will be treated as non-confidential and nonproprietary information.

 

Privacy; Entrant Personal Information: We collect Personal identifying information from all entrants participating in this Sweepstakes (whether or not selected as winner). This information consists of:

 

Identifiers: first name, last name, date of birth, state of residence, email address, and user ID (used via the entry platform)

 

Internet Activity: IP address of the device used to submit entry information, Language entry source and date of entry.

You will not be required to disclose personal financial information to enter the Sweepstakes.

 

Consumer Directed Sharing: Participating in this Sweepstakes requires the sharing of your information with the Participating Companies as described below for the purpose of facilitating this Sweepstakes. We do not collect or share any information of individuals under the age of 18. The Sponsor and the Participating Companies will treat your Personal Information in accordance with their respective privacy policies, links to which are provided below.

 

You agree that we will share your Personal Information with the Participating Companies to send you future marketing communications from Sponsor and Participating Companies regarding the promotion of their respective products, offers, and events.

 

Opt Out: You may unsubscribe from the receipt of such marketing communications at any time by clicking the “unsubscribe” link on each email or in accordance with the process set forth below for each Participating Company.

 

Additional Sharing of Winner’s Information: If an entrant it chosen as a winner, their first name and last initial, city and state, will be shared on a publicly available winner’s list from Sponsor, or as required by law. In addition, the winner’s taxpayer identification number will be shared with applicable tax or licensing authorities as required by law.

 

Right to Know: You have the right to request that the Participating Companies disclose what personal information they collect, use, disclose, and sell. You may make this request by contacting each of the Participating Companies using the contact information (telephone or email) provided in the chart below. You may also designate an agent to make a request on your behalf by submitting a written request and designation of agent to the Participating Companies. In either case, in order to verify your identity, you will need to provide the Participating Companies with a copy of a valid government-issued identification which contains information that accurately corresponds to the information you provided in the submission of your entry into this Sweepstakes. The Participating Companies will verify the information on the copy of the identification provided against the Sweepstakes entry information provided.

 

Right to Delete: You have the right to request that the Participating Companies delete personal information they collect, use, disclose, and sell (if applicable). You may make this request by contacting each of the Participating Companies using the contact information (telephone or email) provided in the chart below. In order to verify your identity, you will need to provide the Participating Companies with a copy of a valid government-issued identification which contains information that accurately corresponds to the information you provided in the submission of your entry into this Sweepstakes. The Participating Companies will verify the information on the copy of the identification provided against the Sweepstakes entry information provided.

 

No Discrimination: You have a right not to receive discriminatory treatment for the exercise of the privacy rights conferred to you under applicable data protection laws.

Publicity Release: Unless prohibited by law, acceptance of a prize shall constitute and signify the winner’s agreement and consent that Sponsor and/or third parties on Sponsor’s behalf, may use the winner’s name, city and state of residence, biographical data, voice, statements, image, likeness, and/or prize won (collectively the winner’s “Name and Likeness”) for marketing and promotional purposes and for any other business purpose, in any media, now known or hereafter developed, throughout the world, including on the Internet, without providing additional notice, consent, review opportunity, or consideration to the winner. Each winner agrees that Sponsor (and third parties on Sponsor’s behalf) has the unrestricted, absolute, perpetual, and worldwide right to reproduce, copy, exhibit, display, perform, transmit, broadcast, distribute, modify, create derivatives of, and otherwise use the winner’s Name and Likeness. Each winner agrees that Sponsor may alter the winner’s Name and Likeness and may combine the winner’s Name and Likeness with other materials and information (including without limitation, text, data, images, photographs, illustrations, animation and graphics, or video or audio segments of any nature, in any media or embodiment, now known or hereafter developed). Each winner accepts and acknowledges that Sponsor shall not be obligated to use the winner’s Name and Likeness, and Sponsor shall not incur any liability whatsoever to the extent Sponsor chooses to refrain from any exploitation of its rights hereunder. Where required by state law, Sponsor will obtain written content from winner(s) prior to usage of “Name and Likeness”.

 

Taxes / Fees. Unless otherwise expressly stated in the Sweepstakes Official Rules, all taxes or incidental expenses (including transfer and license fees) are the sole responsibility of each Prize winner. Except as may be specifically provided in these Official Rules, prizes are not transferable. The prizes may not be substituted or redeemed for cash or other consideration. Each prize winner will be required to complete and submit timely an IRS Form W-9 to Sponsor before a prize will be awarded.

 

Announcement of the Winner. By participating in the Sweepstakes, you agree that Prize winner will be publicly announced via Sponsor’s website, Facebook, and Instagram pages and otherwise following the conclusion of the Sweepstakes Term. Alternatively, for the name of the prize winner, please send a self-addressed, stamped envelope to Sponsor at the following address:

Vermont residents may omit return postage. Requests for the names of the prize winner must be received within sixty (60) days of the last day of the Sweepstakes Term.

 

No Endorsement by Third Parties. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook, Inc., Instagram, or any other companies providing or manufacturing the prizes.

 

Void Where Prohibited. The Sweepstakes is void where restricted by law or otherwise prohibited in whole or in part. The Sweepstakes is strictly for entertainment purposes and may not be used in connection with any form of gambling.

 

Changes to Official Rules. Sponsor reserves the right to change the Official Rules or delay or cancel the Sweepstakes at any time without further obligation or liability if the Sweepstakes cannot be run as planned for reasons outside the control of Sponsor.

 

Disclaimer and Limitation of Liability. Sponsor is not responsible for any incorrect or inaccurate information associated with or utilized in the Sweepstakes, including but not limited to any printing or typographical errors in any Sweepstakes materials, or for any technical or human error, which may occur in the processing of entries in the Sweepstakes. Sponsor has no liability or responsibility for entrant’s participation in or attempt to participate in the Sweepstakes or ability or inability to enter the Sweepstakes or entrant’s participation or lack of participation in any prize-related activity. Sponsor is not responsible for any personal injury or property damage or losses of any kind which may be sustained to entrant’s or any other person’s computer equipment, smart phone or mobile device resulting from participation or attempted participation in the Sweepstakes. Sponsor assumes no responsibility for any incomplete, misdirected, late, or lost entries, or any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, garbled or corrupted data transmitted, inaccessibility of any entry website, theft or destruction or unauthorized access to, or alteration of, entries or entry data, telephone, cable, satellite, network, electronic or Internet connectivity or other online or telephone network communication problems, errors or limitations of any Internet or telephone service providers, servers, hosts or other providers, failure of any online transmissions to be sent or received, or traffic congestion on the Internet or any entry website. If, for any reason, the Sweepstakes is not capable of running as planned, including tampering, unauthorized intervention, fraud, or any other causes beyond the control of the Sponsor which affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. In the event that proper administration of the Sweepstakes is prevented by such causes as contemplated above, Sponsor will pick the prize winner from all eligible, non-suspect entries received prior to such action.

 

Entrants or prize winner agree that Sponsor, its parent, subsidiaries and affiliated companies, Facebook, Inc., and Instagram and any other companies providing or manufacturing the prizes, and their respective officers, managers, members, directors, employees, representatives and agents will have no liability whatsoever for, and shall be held harmless by entrants or the prize winner against, any and all liability, including but not limited to any death, injury, loss or damage of any kind, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation or attempted participation in this Sweepstakes, or while traveling to or from, preparing for or participating in, any prize-related activity, or use or misuse of any prize awarded. The prize winner agrees to hold Sponsor and its affiliates harmless from any and all claims of any type asserted by any third parties arising from or in connection with use or misuse of any prize awarded in this Sweepstakes or breach of any of the terms and conditions of these Official Rules by any entrant or Prize winner.

 

Disqualification. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of any of the Sweepstakes; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Sponsor, its subsidiaries, affiliates and agents, will be the sole judge of all matters relating to this Sweepstakes.

 

General. By entering this Sweepstakes, each entrant or prize winner warrants that, (a) the entrant or prize winner has read, understood and followed these Official Rules; (b) the entrant or prize winner agrees to be bound by all decisions of the Sponsor; and (c) the entrant or prize winner is eligible under these Official Rules. Each potential prize winner may be subject to verification and investigation before being awarded any prize. This Sweepstakes shall be governed by Missouri law. By participating in this Sweepstakes, entrants or the prize winner agree that, except to the extent prohibited by applicable law, (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively by the U.S. District Court for the Western District of Missouri (Central Division) or the appropriate Missouri State Court located in Boone County, Missouri, and submit to the exclusive jurisdiction over any dispute or litigation arising from or relating to this Sweepstakes and that the exclusive venue shall be in Missouri; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event shall there be a claim or award of attorneys’ fees or costs; and (3) under no circumstances will entrants or the prize winner be permitted to obtain, and entrants or prizes winner hereby waive all rights to claim, punitive, incidental and consequential damages and any other damages, other than for individual, actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

 

In case of a dispute over the identity of an entrant who submitted a winning entry, the authorized account holder of the email account associated with that entry will be deemed the entrant. Such owner must comply with these Official Rules, be the person who completed the act of entering, and, in Sponsor’s sole discretion, may be required to provide proof of ownership of the email account.

 

Sponsor’s failure to enforce any term of the Sweepstakes Official Rules will not constitute a waiver of that provision or bar Sponsor from enforcing that term in other circumstances or to any other entrant.

 

The headings in these Official Rules are inserted for convenience and ease of reference, and are not intended to describe, interpret, define or limit the scope or intent of the Official Rules. By submitting an entry, each entrant waives any right he or she may have to claim ambiguity or any advantage or impact on interpretation of these Official Rules that may arise to create any ambiguity claim.
